Real Estate Attorneys - Do They Really Know the Answers?

Well…that depends. Real Estate Attorneys, like all attorneys are interesting in their process. Generally, the way attorneys process information and understand situations is to understand the facts of your situation, read the law (if they don’t know it off hand) and then study the case law relating to similar situations. Case law: meaning prior cases with scenarios similar to yours to see how the courts applied the law to a real life problem. Often case law modifies the interpretation of the law or adds meaning or exceptions and all of this depends on the court the case was processed through.


So what does all of this mean as it pertains to your situation, your life, your home? Attorneys can be very valuable assets and are great at some things, however as it pertains to dealing with the Assessor even attorneys can be very misleading. I once heard an attorney say to his client, “They do whatever they want at the Assessor’s Office.” Which of course, instilled a tremendous amount of fear in his client! He made this statement because he didn’t understand how the Assessor’s Office functions internally, how they apply the law and what internal controls they have to make sure homeowners aren’t taken advantage of.


The funny thing was the question that needed to be resolved by his client was a very simple one and with a phone call to the right person could have been answered. So, before his client took any action affecting her property to lower her property taxes she would be informed. His way of resolving the same issue would have been to spend hours pouring over real estate law and then reading the cases on similar situations which his client would have had to pay for his time and the answer to the question could be resolved with a simple phone call. The rules of law wouldn’t reveal the answer that quickly. Additionally, when reviewing cases – it means the situation had reached the level of a full trial! When most real estate law is transactional and never reaches the level of litigation. Simple investigation with a few phone calls is often the answer especially as it pertains to real property law, property taxes and assessments.


Do I need a Real Estate Attorney to lower my property taxes? Absolutely not.

Lowering your property taxes is generally a simple process, unless you have a unique situation. Lowering your property taxes is primarily based on market value which means understanding appraisal. Understanding the three keys to your property tax value: appraisal, assessment process and property tax law. These three things are much simpler than you may think when broken down. It is so simple that when you have read the Little Black Booklet and gone through the Workbook – you will be shocked at how easy it is! Chances are you will actually be more informed than a real estate attorney when it comes to lowering your property taxes!   


Even when dealing with assessment appeals you will very likely be more effective than a real estate attorney with the knowledge contained in the Little Black Book. You know your home better than anyone else and so with a little education you will be the most effective person The bottom line is often the most effective tool, and that is what the Little Black Book gives you as it pertains to lowering your property taxes.
